Swedish skincare brand, FOREO has won its IP infringement lawsuit against Kingdom Zhuhai’s counterfeit product, KD 308.
The brand's victory also sees a breakthrough compensation amount, the highest ever ruled for design patent infringement, coming in at an excess of over USD$400,000, judged by Shanghai Intellectual Property Court.
"We are delighted with the court’s ruling on protecting our patented innovation, which had taken years in development in bringing our customers unique, and scientifically backed technology," said FOREO Oceania general manager, Ali Shoraka.
The counterfeit product was sold on e-commerce platforms around the world, and infringes upon FOREO’s LUNA Series design patent, NO.ZL201330013432.2.
A warrant was issued, enabling FOREO to obtain object figures from e-retailers, Tianmao Alibaba platforms. Using network platform technologies, FOREO discovered that a huge 358,074 pieces of the KD 308 were sold, amounting to a sales volume of RMB¥35,262,900.
The brand has warned it will be seeking injunctive relief and monetary damages, serving to immediately sue any entity that sells infringing products. FOREO will also be further investing in fighting IP infringement on all fronts, and will continue to actively protect its trademark rights by expanding anti-counterfeiting efforts.
