We may only be in February, but this year has already been rife with beauty companies and celebrities getting involved in lawsuits against one another. Following on from Jay Z getting into hot water and Sofia Vergara suing Venus Concept, the latest sees Kendall Jenner bring a $US10 million lawsuit against skincare company Cutera.
Jenner is suing the skincare giant for using her image in a campaign for their products without her permission. During New York Fashion Week, Cutera ads appeared around the city bearing a likeness to Jenner with a quote from her saying acne had “completely ruined” her self-esteem. The ad also claims the brand’s Laser Genesis treatment is responsible for Jenner’s “nearly flawless skin”.
The complaint reads: "Ms. Jenner's actual endorsement for a worldwide campaign such as this would command a fee well into eight figures. Setting aside the monetary value, however, it is Ms. Jenner's choice whether or not to commercially endorse another party's goods and services. Cutera took that choice away from her."
Jenner has called for Cutera to share profits from the campaign using her image without authorisation to the cost of “in no event less than $US10 million”. The court case is also seeking a restraining order against the skincare company to prevent them from “any use of Kendall Jenner’s name, likeness, identity or person” in future campaigns.
On the court case, the model’s attorney Todd Wilson explains, “[T]he right to associate Kendall Jenner’s name and likeness in connection with a product or service belongs solely to Kendall Jenner and is protected by Federal and State law.”
